By creating an account, accessing, or using Raceday through Raceday.pro, any subdomain of Raceday.pro, the Raceday mobile application, or another Raceday-powered service (collectively, "Raceday" or the "Service"), you agree to these Terms of Service.
You represent that the information you provide is accurate and that you have the legal authority to create and use the account. If you are creating or using an account on behalf of another person, including a minor participant, you represent that you have the authority to do so.
Raceday is a Software as a Service ("SaaS") platform used by race promoters, race facilities, racing associations, clubs, sanctioning bodies, event organizers, and other individuals and organizations involved in motorsports racing and related events. These organizations are referred to in these Terms as a "Promoter" or "Event Organizer."
Raceday provides software and technology that Promoters use to manage activities such as memberships, registrations, classes, divisions, race numbers, add-ons, waivers, orders, communications, event setup, timing information, race results, and general event administration.
Raceday is not the Promoter or operator of the events listed through the Service. The Promoter controls its events, rules, classes, registrations, schedules, refunds, cancellations, results, eligibility requirements, and other event-related decisions.
Raceday is not responsible for losses resulting from your failure to secure your password, email account, mobile device, or other account credentials.
When you register for an event, purchase a membership, reserve a competition number, sign a waiver, purchase an event-related item, or otherwise interact with a Promoter through Raceday, you are entering into a transaction or relationship with that Promoter.
The Promoter determines the information required for participation and is responsible for its event rules, eligibility requirements, schedules, pricing, classes, divisions, refunds, cancellations, waivers, competition procedures, and event administration.
You are responsible for reviewing and complying with the rules, policies, waivers, requirements, and instructions provided by the applicable Promoter.
Raceday collects and uses Personal Data as described in the Raceday Privacy Policy.
Information you provide may be made available to the Promoter or Event Organizer when necessary to administer a membership, registration, event, race, waiver, order, result, or other activity in which you participate.
Raceday does not sell or rent your Personal Data for third-party marketing purposes. Certain information may be processed by service providers used to operate Raceday, process payments, deliver communications, host the Service, provide security, or perform other functions necessary to provide the Service.
Promoters may have their own privacy practices and may use information they receive through Raceday to communicate with participants regarding their organization and events. Questions regarding a Promoter's independent use of your information should be directed to that Promoter.

Creating a Raceday account or accepting these Terms does not by itself enroll you in Raceday text messaging.
If you separately provide your mobile phone number and affirmatively consent to receive text messages, you authorize the applicable sender to send text messages to the mobile number you provided for the purposes described when you gave your consent.
Consent to receive text messages is not a condition of purchasing a product, registering for an event, or using Raceday unless text messaging is independently required for a specific security or verification function that you choose to use.
If you opt in to receive text messages from Raceday, Raceday may send account, transactional, verification, security, registration, and event-related messages.
These messages may include:
Raceday may also provide messaging tools that allow a Promoter or Event Organizer to communicate with participants associated with its organization or events.
If you separately consent to receive text messages from a Promoter or Event Organizer, that organization may send messages through Raceday concerning its memberships, registrations, classes, divisions, races, or events.
These messages may include event schedules, cancellations, delays, staging instructions, registration reminders, membership information, safety information, operational notices, event-day updates, and other information related to the organization or events in which you participate.
Raceday and the Promoter are separate senders. Consent you provide to Raceday does not automatically authorize a Promoter to send unrelated text messages to you. Likewise, consent provided to one Promoter does not automatically authorize Raceday or another Promoter to send unrelated text messages to you.
Promoters using Raceday messaging tools are responsible for obtaining any consent required before sending messages and for complying with applicable laws, regulations, carrier requirements, and Raceday messaging policies.
Message frequency varies depending on your account activity, registrations, events, and messaging preferences. Message and data rates may apply according to your wireless service plan.
You may withdraw consent from an applicable SMS messaging program at any time by replying STOP to a message. Where available, you may also manage certain communication preferences through your Raceday Account Settings.
After an opt-out request is processed, you may receive a final confirmation message. You will not receive additional messages from the applicable messaging program unless you later provide new consent.

Wireless carriers and messaging providers may delay, filter, or fail to deliver messages for reasons outside Raceday's control. Raceday does not guarantee the delivery or timing of any text message.
Raceday does not sell, rent, or share mobile phone numbers, SMS opt-in information, or SMS consent with third parties or affiliates for their marketing or promotional purposes.
SMS opt-in information and consent may be provided to messaging service providers solely as necessary to route, process, or deliver the messages you have agreed to receive.
Raceday may retain records relating to SMS consent, including the date, time, source, method, and scope of consent, as reasonably necessary to operate the Service, document consent, manage communication preferences, and honor opt-out requests.

Raceday may facilitate payments for registrations, memberships, merchandise, add-ons, services, and other items offered by a Promoter.
Payment card information is processed by third-party payment processors. Raceday does not store complete credit card numbers.
Your credit card or financial account statement may display the name of the applicable Promoter, Raceday, a payment processor, or a combination of identifying information associated with the transaction.
If you have a question regarding a registration, charge, order, or event purchase, you should first contact the Promoter responsible for that transaction.
Raceday does not independently determine or provide refunds for Promoter transactions.
Refund eligibility is determined by the applicable Promoter according to that Promoter's policies. A Promoter may choose to issue a refund, credit, transfer, or other accommodation, but Raceday cannot require a Promoter to do so.
If you have questions about a refund, charge, registration, membership, or order, please contact the applicable Promoter.
Promoters control their event schedules and may cancel, postpone, relocate, shorten, modify, or otherwise change an event.
If an event is canceled or changed, the Promoter may, at its sole discretion and according to its policies, issue a refund, credit, transfer, or other accommodation.
Raceday does not control event cancellations or scheduling decisions and cannot independently authorize a refund on behalf of a Promoter.
As a condition of using Raceday, you agree that you will not:
Raceday or the applicable Promoter may remove content, registrations, profiles, or other materials that are determined to violate these Terms, event rules, applicable law, or the rights of others.
Raceday may preserve or disclose information when reasonably necessary to comply with applicable law, legal process, or legitimate requests from law enforcement.
The Raceday platform, including its software, design, graphics, logos, interfaces, databases, functionality, and other original content, is owned by or licensed to Get Raceday, LLC and is protected by applicable United States and international intellectual property laws.
Except as expressly permitted by Raceday, you may not reproduce, duplicate, copy, sell, resell, license, exploit, modify, distribute, or create derivative works from any portion of the Service.
Promoters and users may submit or publish information through interactive portions of Raceday, including event information, membership information, registrations, race results, images, and related materials. The person or organization submitting such content is responsible for ensuring that it has the right to do so.
If you believe copyrighted material has been posted through Raceday without authorization, contact Raceday Support with sufficient information to identify the material, including the applicable URL or location within the Service. Raceday will review the report and take appropriate action when warranted.
Raceday relies on third-party service providers for functions that may include hosting, data storage, networking, email, text messaging, payment processing, analytics, security, and other technologies necessary to operate the Service.
Raceday is not responsible for interruptions, failures, delays, or other problems caused by third-party services that are outside Raceday's reasonable control.
Your use of Raceday is at your own risk.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis.
To the fullest extent permitted by law, Raceday makes no warranty, express or implied, that the Service will be uninterrupted, error-free, completely secure, or that every feature will meet your particular requirements.
Raceday does not guarantee the accuracy of information supplied by Promoters, participants, timing systems, scoring systems, or other third parties, including schedules, registrations, rules, results, standings, event information, or other Promoter-controlled data.
Raceday provides software used in connection with motorsports events but does not organize, manage, operate, sanction, supervise, inspect, or control the physical events listed through the Service unless expressly stated otherwise.
Motorsports activities involve inherent risks, including the risk of serious bodily injury, death, and property damage.
Your participation in an event is governed by the rules, releases, waivers, insurance requirements, safety requirements, and other terms established by the applicable Promoter, facility, sanctioning body, or other event authority.
By choosing to participate in an event, you assume responsibility for evaluating and accepting the risks associated with that participation.
To the fullest extent permitted by applicable law, Raceday, Get Raceday, LLC, and their owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of, or inability to use, the Service.
Raceday is not responsible for injuries, property damage, event cancellations, event operations, Promoter decisions, race results, rules enforcement, participant conduct, or other matters arising from the organization or operation of an event by a Promoter or other third party.
Nothing in these Terms is intended to exclude liability that cannot legally be excluded under applicable law.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Raceday, Get Raceday, LLC, and their owners, officers, employees, contractors, and agents from claims, liabilities, damages, losses, and reasonable expenses arising from or related to:
Participation in a motorsports event may also be subject to separate releases, waivers, indemnification provisions, and assumption-of-risk agreements required by the applicable Promoter or facility.
You are not required to continue using Raceday and may discontinue use of the Service at any time.
Raceday may suspend, restrict, or terminate an account when reasonably necessary to protect the Service, other users, Promoters, or third parties, including in cases of suspected fraud, security concerns, abuse, violations of these Terms, unlawful activity, or misuse of the Service.
A Promoter may separately restrict your participation in its organization or events according to its own rules and policies. A Promoter's decision regarding participation in its events does not necessarily terminate your Raceday account.
For questions relating to an event, registration, membership, class, race result, refund, cancellation, or Promoter policy, please contact the applicable Promoter first.
Raceday Support may assist with technical issues involving the Raceday platform. Promoters may also refer technical issues to Raceday when appropriate.

Raceday may update, modify, add, or discontinue features of the Service from time to time.
We may also update these Terms of Service when necessary. When material changes are made, we may provide notice through the Service, by email, or through another reasonable method.
The Effective Date at the top of these Terms identifies the date of the most recent revision. Your continued use of the Service after revised Terms become effective constitutes acceptance of those revised Terms to the extent permitted by law.
Raceday's failure to exercise or enforce a provision of these Terms does not constitute a waiver of that provision or any other right.
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
These Terms of Service, together with the Raceday Privacy Policy and any additional terms expressly presented through the Service, constitute the agreement between you and Raceday regarding your use of the Raceday platform and supersede prior versions of these Terms relating to the same subject matter.
Separate terms, rules, waivers, releases, or agreements imposed by a Promoter govern your relationship with that Promoter and your participation in its events.
